Kane's Lawyer Responds to the Charges

After two days of silence we're finally starting to get Patrick Kane's side of what happened Sunday morning.  As has been the norm for this story though, only small details are coming out, bit by bit.  Hawksfansince08 gave me the head's up that the lawyer Kane has hired, Paul Cambria was on ESPN1000 this morning on The Waddle and Silvy Show.  Unfortunately I didn't get to hear most of the story but ESPN has a nice summary up.

Lawyers of course speak like politicians at times, avoiding the real questions and answering with their pre-written talking points so we get an answer like this when he's asked if Pat Kane touched the cab driver, Radecki:

"He did not assault the cab driver. He did not rob the cab driver. He did not cheat him out of his fee. None of those things. He tried to get out of a locked cab,"

So there's no mention of whether or not Pat actually "touched" the cabbie but this does support the stories we've heard of the Kanes being locked inside the cab.  Later in the interview though Cambria does give more details

Cambria does go on to say:

 

"Pat is like, 'Why me? I didn't hit the guy. I didn't assault the guy. I wasn't involved in pay or not paying for the fare. I can't believe I'm in this.' "

 

So maybe Pat didn't actually do any of the punching after all?  We'll have to see if that's true.  If anything this interview makes it sound like was Pat's cousin, and him alone, that was involved with paying for the cab and possibly any physical confrontation.  That would go against what the driver initially said to reporters though.   Also mentioned on show was the news that everything is going to be going in front of a Grand Jury on Thursday and there are sure to be a lot more details coming out then.

Until then, there's plenty of dirt being drug up on the cab driver - Sun Times is reporting he's been arrested twice for driving under the influence and doesn't actually have a valid driver's license.  Ouch. As quick as we are to jump on Kane for being an idiot, lets now try to hold off judging this guy.  He's allegedly been sober after attending AA.  Even with a shady past, he doesn't deserve to get punched out over 20 cents. 

What could end up being more damaging to his story than his legal past could be this bit of news also from the ESPN1000 interview:

Cambria said "Apparently, he's had other skirmishes with people in the past, and other difficulties, and all that will play out in the courtroom."

Now there's nothing to back that up other than rumor at this point but it could be a huge boost to Kane's defense.  As big of a jerk as Kane might be, and I'm not really sold on the idea that he's an insufferable prick, he can afford the type of lawyer that could (right or wrong) absolutely destroy the credibility of an older alcoholic cabbie with a history of legal problems and a tendency to fight with his fares. 

For the time being though we'll have to just wait for more details to leak out.

One more point

On espn.com, it said that the cabbie had been convicted of a pair of DWI’s and had no valid driver’s license. Without defending or accusing anyone, it’s ironic that the Kane cousins would be in a cab at 5am trying to do the right thing by avoiding a DUI.

Regardless of the details and outcome, I’d bet good money that the Kanes never had “do the right thing” on their mind at any point that night. About all I ever had on my mind at that time of night, when I was that age, was a girl, or girls. And if I was in a cab with only my cousin directly after close, the only thing I was thinking was, Fuck me, maybe if we went back ….

One note on grand jury proceedings

Anything said inside the room is kept secret. The only thing that will happen is that the Kanes will be indicted or not indicted. Even then the prosecutor could still file charges on his own and the old saying goes that a good prosecutor can get a ham sandwiche indicted.

In other words, don’t expect a lot more information unless the prosecutor comes out and talks about the grand jury decision.

Better be throwing some apologies PK88’s way when this turns out to be bullshit.

The Cabbie is a scumbag, sounds like, and at the very least has some questionable business practices.

Looks like the only thing PK is guilty of is being in the wrong place at the wrong time. It’s a shame people have turned this into a assult on his character.

Why should people apologize to Kane? We aren’t likely to ever get the real story now, but for now, the fact remains that Kane really did get busted and taken down for processing. It’s not a James Brown or Nick Nolte worthy mugshot, but it’s a mugshot nonetheless. Kane’s character being assaulted is nothing new, we were doing that for a lot of the end of the season. The cabbie may be a jagoff after all, but Kane was the one who went to jail instead of the cabbie. I understand Kane is just 20 and drinking beer and getting laid is about all 20 year olds care about. Still, he is a rich 20 year old who is going to attract major attention even if he is simply there while someone else did something illegal. Rich people don’t like to live in our world and deal with the reality we do and I don’t have a problem with that. When you drop into our world though and bitch when you get popped for some stupid shit like this, you live with the consequence of that. If this helps him to pull his head out of his ass, all the better it happens now then before a Theo Fleurry type guy can show him how to REALLY have a good time.

should apologize because as it looks it right now, people are letting a bullshit story frame their opinion towards someone.

Prior to this story, Kane was arrogant on the ice and perhaps somewhat aloof on D. Now, and I’m seeing a lot of people try to stir up this sentiment that he’s some sort of entitled, unappreciative rich kid.

I don’t know if he is, and I don’t care. I only care about what he does on the ice.

However, an opinion based on a falsity is bullshit. If people have the sack to throw
it out there, then they should have the sack to take it back.

Sure

I expect a lawyer to do what they do best.

But, when the cabbie has a history of altercations with passengers that tells me all I need to really know. Holding people captive in the back of your cab and letting them go once you get your fare + tip is basically holding someone against their will.

Haven’t people fallen for this shit enough? Some dipshit, finds a way to weasel money from a celeb and it’s the celeb who suffers the fallout. Duke Lacrosse, Ray Lewis, Ben Rothelisberger. All bullshit, all trumped up charges.

And yet for some people, it’s out of the realm of possibility to believe that some cabbie. Mind you, who isn’t a first time offender in regard to locking his passengers in the car, would trump up some charges against an NHL star?

Who cares? When Kane scores 40 goals this year as a 21 year old and gets arrested for public drunkenness and assault for dropping the cup on Burish’s head. You’ll love him. The kid can play hockey, which is all that matters because that is the only reason we even know who he is.

Well yes, of course

he just randomly happened to be in a cab at approximately 4 am (closing time) coming home from the bars. Wrong place, wrong time, could happen to anyone. Frequently I find myself out shopping the midnight sales, can’t remember where I left the car, and take a cab home. Scuffles sometimes ensue because I don’t like cab drivers who may have told me they are in AA or make me pay them.

I didn’t read anywhere that the cabbie was from Detroit, either.

But it requires an actual BA there (I think), unlike Missouri where a cop can just say “you’re drunk!” and then cite you. Given everything else that was going on, I doubt the cops thought about it.

Yes, and Paul Cambria is very good and a very expensive lawyer. He was probably hand picked by the family or someone else with a interest in Kane’s future.

I was even worse, I corrected them. Any misspellings, or if they made a mistake when we covered the classics, I would be sure to let them know the error of their ways. They did not seem to enjoy it for some reason.

The script of what will happen...

1. Kane’s cousin will take the fall in deference to Patrick coming out as clean as possible in this mess.

2. The cabbie will have a six figure wire transfer made into his checking account courtesy of Patrick Kane.

So in the end drunkedness and 20 cents will wind up costing Patrick Kane a couple hundred thousand in victim payoff and lawyer fees. That and he will owe his cousin a huge debt of gratitude.

I think it’s more plausible that Kane’s tagalong cousin was responsible for most of this anyways. The only things that exceeds the ego of a professional athlete are the oversized egos in his/her entourage.

I don’t think it’s completely irrelevant to call into question the credibility of a guy who might have a history of being a liar. Not saying that he deserved the supposed beating because of his history, but it does make me (or perhaps a judge) think twice about the truthfulness and validity of the story he is telling.
